Quick answer: To keep the Prop 19 tax base on a Mission Viejo home inherited from a parent, an heir must make it their principal residence and file the homeowners' exemption within one year, then file form BOE-19-P within 3 years (BOE). Renting it out ends the exclusion. A probate sale needs a Notice of Proposed Action or court supervision.

Inherited a home in Mission Viejo, or settling an estate that owns one? I'm Darren Shepherd, a Mission Viejo listing agent. This guide covers how often trust and probate homes sell here and what they sold for, the Prop 19 rules for keeping the tax base, what renting the home out does to the property tax, and how a probate sale works in California.
Sale figures come from CRMLS, the regional multiple listing service. Tax and legal rules come from the California State Board of Equalization (BOE), the Orange County Assessor, the California Probate Code, the Superior Court of Orange County and the IRS, each linked below. This is general information, not legal or tax advice. Talk to a probate or estate attorney and a CPA about your situation.
What this guide does not cover: writing a will or trust, estate tax returns, property outside Mission Viejo, and loans or refinancing.
How many Mission Viejo homes sell as trust or probate sales?
160 of the 958 Mission Viejo homes that closed in the last 12 months, or 16.7%, were listed with a Trust or Probate Listing condition (CRMLS, closed Oct 19, 2025 to Oct 18, 2026).
- Trust: 150 sales carried a Trust tag, and 87 of them were also tagged Standard.
- Probate Listing: 10 sales.
- Single-family homes: 129 of the 740 single-family sales were trust or probate sales.
- All other property types: 31 of 218 sales.
The tag shows how the listing agent described the sale in CRMLS, not why the owner sold.
What did trust and probate homes sell for in Mission Viejo?
$1,250,000 was the median sale price for the 129 Mission Viejo single-family trust or probate sales, against $1,350,000 for the 602 standard single-family sales (CRMLS, same 12 months).
- Single-family, trust or probate: median $1,250,000, $635 per square foot, 13 days on market, median 1,924 square feet, a median 99.2% of the final list price, and 59 of 129 closed at or above list.
- Single-family, standard: median $1,350,000, $682 per square foot, 17 days on market, median 1,940.5 square feet, a median 99.6% of the final list price.
- Other property types, trust or probate: 31 sales, median $780,000, 17 days on market.
- Other property types, standard: 183 sales, median $749,000, 21 days on market.
- Listed condition of the 160 trust or probate sales: Turnkey on 60, Updated/Remodeled on 53, Repairs Cosmetic on 11 and Fixer on 9 (a listing can carry several tags or none).
$100,000 separated the single-family medians, and $47 per square foot. The data shows what these homes sold for, not why: the homes themselves differ in condition and location.
Source for every figure in these 2 sections: CRMLS, closed Oct 19, 2025 to Oct 18, 2026, City = Mission Viejo, deduplicated by listing ID. Trust or probate = the Special Listing Conditions field contains Trust or Probate Listing; standard = Standard only. Price per square foot is the median of close price divided by living area. Days on market is CRMLS DOM.
Can you keep an inherited Mission Viejo home's Prop 19 tax base?
1 year is the window. Yes, if the home was the parent's principal residence and becomes the heir's principal residence within one year, per the Orange County Assessor and the BOE. Under Prop 19, this parent-child exclusion covers transfers on or after February 16, 2021.
- The clock starts at death: for inherited property, the date of death is the date of change in ownership, according to BOE Publication 800-1. That includes a home held in a trust.
- Homeowners' exemption: the heir files for it within one year of the transfer. A claim filed later starts the exclusion in the year it is filed, but there is no exception to the one-year move-in rule.
- Form BOE-19-P: the claim is filed with the Orange County Assessor within 3 years of the date of death, or before a transfer to a third party, whichever is earlier. The Assessor lists the current form with no filing fee.
- Value limit: the excluded amount is the factored base year value plus $1,044,586 for transfers from February 16, 2025 through February 15, 2027. Market value above that sum is added to the taxable value.
- Co-heirs: if several siblings inherit the home, only one of them needs to live in it. If one buys out the others, the share that changes hands between them is reassessed.
The BOE's own example: a home with a $300,000 factored base year value and a $1,500,000 market value gets a new taxable value of $500,000, using the original $1 million amount. The BOE also says its Prop 19 summary is not a legal interpretation and encourages consulting an attorney.
What happens to the property tax if you rent the inherited home out?
Renting the home out ends the exclusion. The BOE says the transfer of a rental home does not qualify for the parent-child exclusion, and Publication 800-1 says that once the home is no longer the heir's principal residence, "such as becoming a rental property, the exclusion is removed."
- New taxable value: as of the January 1 lien date after the heir moves out, based on the market value on the date the heir took ownership, adjusted each year for inflation.
- Never moved in: if no heir moves in within one year, the property does not qualify for the exclusion.

Executors and heirs: what would the home sell for today?
Whether you keep, rent or sell, the decision starts with a number. I prepare a comparative market analysis (CMA) from the Mission Viejo sales closest to the home in size, condition and location, with my recommended list price in writing. Free, with no obligation to list. A CMA is not an appraisal, so ask your attorney or CPA whether the estate also needs one.

How does selling an inherited home through probate work?
2 levels of court authority shape a probate sale. Under the Independent Administration of Estates Act, the personal representative (the executor or administrator) has either full or limited authority.
- Full authority: the personal representative has the power to sell real property of the estate, after giving a Notice of Proposed Action (Probate Code sections 10511 and 10580).
- Limited authority: a sale of real property requires court supervision (section 10501). The Orange County court strongly recommends an attorney experienced in probate sales for a court-supervised sale.
- Notice timing: the notice is delivered at least 15 days before the date it names for the sale, under section 10586, to each known heir or devisee whose interest would be affected, among others (section 10581).
- Objections: anyone entitled to notice can object in writing. If the personal representative has notice of an objection, the sale has to go through court supervision (sections 10587 and 10589).
- What drops away: when the sale runs under this authority, court-confirmation requirements such as publication of notice of sale, court approval of agents' and brokers' commissions and sale at not less than 90 percent of appraised value do not apply (section 10503).
- Where: Orange County probate cases are heard at the Costa Mesa Justice Complex, 3390 Harbor Blvd., Costa Mesa, per the Superior Court of Orange County.
- Timeline: the court's probate overview says the personal representative must complete probate within one year from appointment, or 18 months if a federal estate tax return is filed.
- Living trust: the court says property held in a living trust passes to the beneficiaries without probate.
This is not legal advice. Have a probate attorney confirm the authority on the Letters (the court document that makes the personal representative's appointment effective: Letters Testamentary or Letters of Administration) and the notice list before the home goes on the market.
Why does the date-of-death value matter if you sell?
3 rules point back to the date of death.
- Tax basis:IRS Publication 551 says the basis of property inherited from a decedent is generally its fair market value at the date of death, or on the alternate valuation date if the personal representative chooses alternate valuation.
- Probate inventory: within four months after appointment, the personal representative files an inventory with an appraisal of each item's fair market value as of the date of death, per the Orange County court.
- Prop 19: the date of death is the date of change in ownership, which starts the one-year move-in and exemption clocks.

Should you sell, keep or rent an inherited Mission Viejo home?
3 paths are open to heirs. Pick the one that matches who will live in the home and what the estate needs.
- Choose to keep it if an heir will make it their principal residence within one year and can file the homeowners' exemption and BOE-19-P on time. That is the only path that keeps the Prop 19 tax base.
- Choose to rent it if the rent still works with the property tax reset to market value as of the date of death, plus inflation adjustments, from the lien date after the exclusion ends.
- Choose to sell if no heir will live there or the estate needs cash: the 129 single-family trust or probate sales closed in a median 13 days, at a median 99.2% of list (CRMLS, same 12 months).

Frequently Asked Questions
Do I have to move into an inherited Mission Viejo home to keep the Prop 19 tax base?
Yes. Per the BOE, the home must have been the parent's principal residence and must become the heir's principal residence within one year. The heir also files the homeowners' exemption within one year and form BOE-19-P with the Orange County Assessor within 3 years of the date of death, or before a transfer to a third party.
Can I rent out an inherited home and keep the Prop 19 exclusion?
No. The BOE says the transfer of a rental home does not qualify, and once the home is no longer an heir's principal residence it gets a new taxable value as of the next lien date, based on its market value on the date of inheritance, adjusted for inflation.
How much notice does a probate sale need in California?
Under Probate Code section 10586, a Notice of Proposed Action is delivered at least 15 days before the date named for the sale when the personal representative has full authority. With limited authority, or after a written objection, the sale goes through court supervision.
How many Mission Viejo homes sell as trust or probate sales?
160 of the 958 Mission Viejo homes that closed from Oct 19, 2025 to Oct 18, 2026, or 16.7%, were listed with a Trust or Probate Listing condition, per CRMLS. The 129 single-family trust or probate sales had a $1,250,000 median price.
